Rajasthan makes misbehaviour with tourists a cognizable crime

Rajasthan government passes a law making misbehaviour with tourists cognizable crime. If the misbehaviour is repeated, it will be non-bailable.

The Rajasthan government on Monday passed the Rajasthan Tourism Business Bill, 2021 in the state assembly under which any misbehaviour with tourists will be a cognizable crime.

The state government regulated an amendment bill in the assembly with a new section 27-A inserted in the Rajasthan Tourism Trade (Facilitation and Regulation) Act, 2010. 

The section “Offences to be cognizable” specifies that all the offences punishable under this Act shall be cognizable and bailable. So, any misbehaviour with tourists especially by touts will now be considered a cognizable crime. If the misbehaviour is repeated, it will be non-bailable.

The touts often mislead and force tourists to shop, usually at expensive prices in connivance with the establishments, earning a commission in the process. Rajasthan is a pioneer in the tourism industry and every year lakhs of domestic and foreign tourists visit the state.  

State Tourism Minister, Govind Singh Dotasara, while presenting the Bill in the House, said that the Bill was brought in the year 2010 to improve the pace of tourism and prevent misbehaviour to ensure that tourists return with a good experience in the state. 

However, the Act did not mention that offences were cognizable and whether the punishment was bailable or non-bailable. Therefore, amendments had to be made and the offence has now been brought under the category of cognizable offence.
